1. Acceptance of these Terms
These Terms of Use govern your access to and use of:
- NemechekNavigator.com
- The Nemechek Navigator community hosted at p319101.invisionservice.com
- Navigator Foundation and Premium memberships
- Navigator AI Advisor
- Progress tracking tools
- Videos, guides, calculators, forums, downloads, and related services
These services are operated by Autonomic Recovery, LLC and are collectively referred to in these Terms as “Nemechek Navigator,” “Navigator,” “we,” “us,” or “our.”
By visiting, registering for, purchasing, accessing, or using any part of Nemechek Navigator, you agree to these Terms of Use and our Privacy Policy.
If you do not agree to these Terms, do not use Nemechek Navigator.
2. Adults only
Nemechek Navigator accounts are intended for adults who are at least 18 years old.
Parents and legal guardians may use Navigator to obtain educational information concerning a child, but children should not create accounts or directly submit personal information.
By creating an account, you represent that you are at least 18 years old and legally able to agree to these Terms.
3. Educational information only
Nemechek Navigator provides general educational information and support resources.
Navigator does not provide individualized medical advice, diagnosis, treatment, prescriptions, emergency care, or professional healthcare services.
Information provided through Navigator:
- Is not a substitute for evaluation or treatment by a qualified healthcare professional
- Should not be relied upon as the sole basis for making medical decisions
- May not be appropriate for every individual
- Does not account for every medical condition, medication, allergy, contraindication, or personal circumstance
You should consult an appropriate healthcare professional before starting, stopping, or changing any medication, supplement, diet, treatment, device, or healthcare plan.
4. No physician-patient relationship
Use of Nemechek Navigator does not create a physician-patient relationship between you or your child and Dr. Patrick Nemechek, Autonomic Recovery, LLC, or any contributor to Navigator.
A physician-patient relationship is created only through a separate, formal clinical arrangement with an appropriately licensed healthcare professional.
Participation in a forum, use of the AI Advisor, submission of a question, completion of a tracker, or viewing of educational material does not establish such a relationship.
5. Emergencies
Nemechek Navigator is not an emergency service and is not monitored for emergencies.
Do not use Navigator to seek urgent or emergency medical assistance.
In a medical emergency, call 911 or the appropriate local emergency number, or go to the nearest emergency department.
For urgent concerns involving medication reactions, poisoning, self-harm, abuse, severe behavioral changes, or rapidly worsening symptoms, contact an appropriate emergency or healthcare service immediately.
6. Membership levels
Navigator may offer different membership levels, including Foundation and Premium.
Foundation Membership
Foundation Membership may include limited access to introductory educational materials and selected tools.
Foundation features may change over time and may include restrictions on posting, uploading, commenting, tracking, or accessing Premium content.
Premium Membership
Premium Membership may include expanded educational resources, problem-solving tools, AI access, community participation, tracking features, discounts, and other Premium services.
The exact features included in each membership level are described on the applicable membership page and may be updated periodically.
We may add, modify, replace, or discontinue particular features as Navigator develops, provided that we do not misrepresent the nature of a paid membership.
7. Premium fees and automatic renewal
Premium Membership is currently offered as a recurring monthly subscription unless otherwise stated at enrollment.
By purchasing Premium Membership, you authorize the applicable payment provider to charge the stated membership fee and any applicable taxes at the beginning of each billing period until you cancel.
The price shown at enrollment will apply unless you are given notice of a future price change.
You are responsible for keeping your billing information accurate and current.
8. Cancellation and refunds
You may cancel Premium Membership at any time through the available account or subscription-management process.
After cancellation:
- Future recurring charges will stop
- Premium access will ordinarily continue through the end of the current paid billing period
- Your membership may then revert to Foundation or another available access level
Except where required by law:
- Payments are nonrefundable
- No prorated refunds or credits are provided for partial billing periods
- Failure to use Navigator does not create a right to a refund
Nothing in this section limits any nonwaivable rights provided by applicable law.
Recurring membership terms and cancellation methods should be presented clearly before enrollment, and cancellation should be reasonably accessible.
9. Account security
You are responsible for:
- Providing accurate registration information
- Maintaining the confidentiality of your password
- Restricting access to your account and devices
- All activity conducted through your account
- Promptly notifying us of suspected unauthorized access
Accounts are personal and may not be sold, transferred, shared, or used by multiple unrelated households unless we expressly permit it.
We may require a password reset or other security action when reasonably necessary to protect an account or the service.
10. Navigator AI Advisor
Navigator AI Advisor is an automated educational tool.
AI-generated responses may be incomplete, inaccurate, outdated, misunderstood, or inappropriate for a particular person. The AI Advisor may not recognize emergencies, contraindications, medication interactions, unusual conditions, or important facts that were not included in the question.
You agree that:
- AI responses are educational and not medical advice
- AI responses do not replace professional judgment
- You will independently evaluate information before acting on it
- You will not use the AI Advisor for emergencies
- You will not submit unnecessary personally identifying information
- You remain responsible for decisions made after using the AI Advisor
We do not guarantee that the AI Advisor will always be available or produce a correct or complete response.
11. Progress Tracker and other tools
Progress Tracker results, dosing calculators, questionnaires, roadmaps, and similar tools are provided for educational and organizational purposes.
They are not diagnostic instruments and are not intended to establish medical improvement, treatment efficacy, disability status, eligibility for services, or any clinical diagnosis.
Tracker scores may be influenced by subjective reporting, incomplete information, changes in the person completing the tracker, or other factors.
You are responsible for deciding whether and how to share tracker results with a healthcare professional.
12. Community participation
Premium members may be permitted to post questions, comments, replies, images, documents, or other content.
You agree to participate respectfully and not to:
- Harass, threaten, intimidate, or abuse another person
- Post hateful, discriminatory, obscene, or sexually explicit content
- Promote violence, self-harm, illegal activity, or dangerous conduct
- Impersonate another person
- Misrepresent professional qualifications
- Solicit or provide individualized medical treatment as though a professional relationship exists
- Advertise, spam, recruit, or promote unrelated products or services without permission
- Share another member’s private communications without authorization
- Attempt to access restricted accounts, systems, or data
- Upload malware or interfere with the operation of the service
- Violate intellectual-property, privacy, publicity, or other legal rights
We may edit, hide, move, restrict, or remove content that violates these Terms or interferes with the safe and useful operation of the community.
13. Information about children and other persons
Parents and guardians should minimize the amount of identifying information they share about a child.
Do not post unnecessary information such as:
- Full names
- Exact dates of birth
- Home addresses
- School names
- Telephone numbers
- Medical-record numbers
- Insurance details
- Government-issued identifiers
- Identifiable records or photographs
You represent that you have the legal authority to submit any information, image, document, or other content concerning another person.
14. Member content
You retain ownership of original content you submit.
By submitting content to Navigator, you grant Autonomic Recovery, LLC a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, format, transmit, and otherwise use that content as reasonably necessary to operate, moderate, secure, and improve Navigator.
This license does not authorize us to sell your personal story or image for advertising without additional permission.
You are responsible for your submissions and represent that:
- You own the content or have permission to submit it
- The content is accurate to the best of your knowledge
- The content does not violate another person’s rights
- The content does not violate applicable law
Deleting an account may not automatically remove content that has become part of an ongoing discussion, backup, legal record, or security record.
15. Testimonials and shared experiences
Member experiences and testimonials describe individual experiences and do not guarantee that another person will achieve the same result.
Outcomes may vary substantially.
Nothing posted by another member should be interpreted as medical advice or proof that a particular intervention is safe or effective for every person.
Health-related claims used in marketing must be truthful, not misleading, and appropriately supported; testimonials cannot be used to imply unsupported typical results.
16. Intellectual property
Nemechek Navigator and its original content, including text, graphics, videos, books, guides, databases, question-and-answer materials, algorithms, trackers, designs, logos, trademarks, and software, are owned by or licensed to Autonomic Recovery, LLC and are protected by applicable intellectual-property laws.
Your membership gives you a limited, personal, revocable, nonexclusive, nontransferable right to access authorized content for your own household’s educational use.
You may not, without written permission:
- Copy or reproduce substantial portions of Navigator content
- Republish content on another website, forum, course, social-media account, database, or AI system
- Sell, sublicense, distribute, or commercially exploit content
- Record, scrape, download, or systematically extract protected materials
- Share paid materials with nonmembers
- Remove copyright, trademark, or ownership notices
- Create derivative commercial products from Navigator materials
- Use automated tools to collect or index restricted content
Limited quotations may be permitted when allowed by law and accompanied by appropriate attribution.
17. Third-party services and links
Navigator may link to or integrate with websites, videos, forms, payment services, community platforms, or other services operated by third parties.
We do not control and are not responsible for third-party:
- Content
- Availability
- Security
- Privacy practices
- Products
- Representations
- Terms or policies
A link or integration does not necessarily constitute an endorsement.
Your use of a third-party service may be governed by that provider’s own terms and privacy policy.
18. Availability and changes
We may update, modify, suspend, restrict, or discontinue any part of Navigator at any time.
We do not guarantee that:
- Every feature will remain available
- The service will operate without interruption
- Content will always be current
- Errors will be corrected immediately
- The service will be compatible with every browser or device
We may perform maintenance, updates, security work, or other changes without advance notice when reasonably necessary.
19. Suspension or termination
We may warn, restrict, suspend, or terminate an account when we reasonably believe that a user:
- Violated these Terms
- Misused the community
- Shared restricted content
- Threatened another person
- Created a security risk
- Used the service unlawfully
- Failed to pay applicable fees
- Attempted to evade a prior suspension
- Interfered with the operation of Navigator
Serious violations may result in immediate termination.
Termination for violation of these Terms does not automatically entitle the member to a refund.
You may stop using Foundation Membership at any time and may cancel Premium Membership as described above.
20. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEMECHEK NAVIGATOR IS PROVIDED “AS IS” AND “AS AVAILABLE.”
AUTONOMIC RECOVERY, LLC DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.
WE DO NOT WARRANT THAT:
- NAVIGATOR WILL MEET YOUR PARTICULAR NEEDS
- ANY INFORMATION OR AI RESPONSE WILL BE COMPLETE OR ERROR-FREE
- ANY PARTICULAR HEALTH, DEVELOPMENTAL, BEHAVIORAL, OR FUNCTIONAL RESULT WILL OCCUR
- ACCESS WILL BE CONTINUOUS OR SECURE
- ALL DEFECTS WILL BE CORRECTED
Some jurisdictions do not permit certain warranty exclusions, so some of these exclusions may not apply to you.
21. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTONOMIC RECOVERY, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, CONTRIBUTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
THIS INCLUDES DAMAGES ARISING FROM:
- RELIANCE ON EDUCATIONAL OR AI-GENERATED INFORMATION
- HEALTHCARE OR TREATMENT DECISIONS
- LOSS OF DATA
- LOSS OF ACCESS
- ACCOUNT MISUSE
- MEMBER CONDUCT
- THIRD-PARTY SERVICES
- INTERRUPTION OF THE SERVICE
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO NAVIGATOR WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID FOR NAVIGATOR DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
- ONE HUNDRED U.S. DOLLARS
Some jurisdictions do not permit certain limitations of liability, so some limitations may not apply to you.
22. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Autonomic Recovery, LLC and its owners, officers, employees, contractors, licensors, contributors, and affiliates from claims, liabilities, damages, judgments, losses, and reasonable costs arising from:
- Your misuse of Navigator
- Your violation of these Terms
- Your submitted content
- Your violation of another person’s rights
- Your unlawful conduct
This obligation does not apply to the extent a claim results solely from conduct for which indemnification may not lawfully be required.
23. Governing law and venue
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any legal action arising from these Terms or Navigator must be brought in a state or federal court with jurisdiction in Maricopa County, Arizona.
You consent to the personal jurisdiction and venue of those courts.
24. Changes to these Terms
We may revise these Terms periodically.
The updated Terms will be posted with a revised “Last updated” date.
Material changes may also be communicated through the website, community, account notice, or email.
Continued use of Navigator after revised Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
25. Severability
If any provision of these Terms is found unenforceable, that provision will be limited or removed only to the minimum extent necessary.
The remaining provisions will continue in effect.
26. No waiver
Failure to enforce a provision of these Terms does not waive our right to enforce it later.
27. Entire agreement
These Terms, together with the Privacy Policy and any additional terms presented during enrollment or use of a specific feature, constitute the entire agreement concerning your use of Navigator.
